I am interested in purchasing property, what do I need?

  • A copy of the owner’s deed
  • A title investigation certificate
  • Land and property tax receipt showing 0 balance
  • A copy of the owner’s ID card
  • A copy of the survey plan (if the land has been surveyed)
  • A recent valuation will be helpful
  • A written agreement for sale will be helpful
  • You should also conduct a physical inspection of the property and have the specific boundary marks pointed out to you by a licensed land surveyor.
  • If purchasing land with someone else; how is the property to be held?
  • Am I legally entitled to purchase property in St. Vincent and the Grenadines, or do I need to apply for an alien land holding license?

I am interested in selling property, what do I need to ensure?

  • Is the land currently mortgaged to a financial institution?
  • If there is a mortgage and the loan was repaid – is there a registered release/re-conveyance?
  • If there is an outstanding balance on my mortgage, is the mortgagee aware of my intention to sell?
  • Am I the only owner or do I own the property jointly? Has the co-owner agreed to sell?
  • Have I already disposed of this land before? This is crucial especially where lands were subdivided for sale. You can attract civil liability for attempting to sell property that is not or no longer yours.
  • Are there any restrictive covenants in my deed?
  • Do I have land and property taxes outstanding on my property?
  • A recent valuation will be helpful
  • An agreement for sale will be helpful
  • Is my prospective buyer legally entitled to purchase property in St. Vincent and the Grenadines? Have they been granted a license relative to my property?
  • In the case of Deeds of gift, have I appropriately considered a life interest or joint ownership?

 

I want to apply for a Probate or Letters of Administration, what do I need?

  • Death certificate of the deceased
  • A form of photo ID
  • A copy of the will (if there was a will)
  • An original copy of the document that entitles me to apply – (marriage certificate, birth certificate etc.)
  • Original certificates of all the beneficiaries – (marriage certificate, birth certificate(s) etc.)
  • Document clearing off person entitled in priority (decree absolute, death certificate(s) etc.)
  • Was there a life interest or minority interest in the property?
  • Title deeds/ registration title document in the name of the deceased (land, vehicle, bank accounts, shares, life insurance policies).
  • A recent valuation of the properties to be included in the application.
  • List of liabilities (mortgage, loan, funeral expenses etc.)
